Court Rules Husted is Still Bound by Consent Decree on Provisional Ballots Agreed to by Previous Secretary of State

Ohio’s previous Secretary of State Jennifer Brunner agreed to a consent decree that provisional ballots are valid when they are cast in the right building, but in the wrong precinct, as long as the voter provided the last four digits of his or her social security number and the mistake was made due to poll worker error.

Ohio’s current Secretary of State Jon Husted wishes to no longer count those provisional ballots, but a U.S. District Court Judge has held he must abide by the terms of the consent decree. Husted may yet appeal the decision.
